Terms of Service

Please read carefully the following Terms and Conditions of Use (hereinafter and indistinctly Terms) of https://admin.cleta.app/, https://cleta.app/ and its mobile application (hereinafter and indistinctly Cleta) of the Cleta service (hereinafter, the ‘Service’), offered by the Technological University of Uruguay (hereinafter, ‘UTEC’). The Service software has been developed by the student team ‘Fiets’ as part of their final degree project. The use of the Portal, its services or contents implies the full and unreserved acceptance of all the provisions contained in the version published at the time the user accesses the site.

1. Entity Definitions

1.1. Definition of UTEC Community

For the purposes of these Terms and Conditions, “UTEC Community” shall mean the following active members:

  • Students: Persons enrolled in careers taught by the Technological University of Uruguay (UTEC).
  • Teachers: Academic staff with a current contract at UTEC.
  • Officials: Administrative and service staff with a current contract at UTEC.

1.2. Definition of Cleta

Cleta is a project developed by the Fiets team, whose objective is to provide a comprehensive technological solution for the management of bicycle loans within the community of the Technological University of Uruguay.

2. User Conditions

The access and use of the different platforms associated with Cleta are subject to the following conditions, depending on the type of user:

2.1. Access to the public website

The Cleta website is freely accessible and can be consulted by any interested person. Its purpose is to provide general information about the operation of the system, conditions of use, contact and other informative or institutional content.

Access to this section does not require registration or identity validation. However, browsing the web implies full and unreserved acceptance of these Terms and Conditions.

2.2. Administrative Panel

The Cleta administrative panel is an internal management tool, accessible only to users with an administrator profile, previously authorized by Fiets or by the competent authorities of UTEC.

The use of the panel is restricted, and requires personal and non-transferable credentials. Any improper use, unauthorized access, or data manipulation without consent will be considered a serious infringement and may lead to corresponding legal actions.

Administrators undertake to use the tools and access to data exclusively for operational, management and maintenance purposes of the Service. The following are strictly prohibited:

  1. Abuse of Privileges: Using the panel’s functionalities to obtain personal advantages or to grant undue benefits to themselves or third parties. This includes, but is not limited to, manipulating usage limits, preferential assignment of bicycles, or altering loan records without valid operational justification.
  2. Improper Data Access: Consulting users’ personal data outside the strict needs of service management, technical support, or duly documented incident investigation.
  3. Data Manipulation: Altering, modifying, or deleting records maliciously or without due authorization and justification.

Any improper use, unauthorized access, data manipulation or breach of responsible use obligations will be considered a serious infringement. UTEC reserves the right to revoke administrator access immediately, as well as to initiate corresponding disciplinary, administrative or legal actions.

2.3. Mobile application

The Cleta mobile application is intended exclusively for people who are part of the UTEC community, i.e., duly identified students, teachers and officials.

To use the application and access the system’s functionalities, users must:

Authenticate using their institutional email account ( @estudiantes.utec.edu.uy / @utec.edu.uy ), through a federated authentication system provided by Google (OAuth)

The system will automatically validate that the account belongs to the institutional domain mentioned, and otherwise, will deny access. Access is restricted exclusively to people who are part of the UTEC community (students, teachers, and officials).

Each user is responsible for maintaining the confidentiality of their access credentials and their institutional account, as well as any activity carried out from their session. Fiets will not be responsible for improper access, identity theft or unauthorized use of institutional accounts.

The use of institutional credentials implies that the user also accepts and complies with the account use policies defined by UTEC.

3. Conditions of access and use of Cleta

The use of Cleta is free for the user, who undertakes to use it respecting current national regulations, good customs and public order, committing in all cases not to cause damage to Cleta, another user or third parties.

In its merit, the user will refrain from using Cleta, its contents or any of its services for illicit purposes or effects, prohibited in these Terms, in technical or legal norms, harmful to the rights and interests of Fiets, other users or third parties, or that in any way may damage, disable, overload, deteriorate or prevent the normal use of Cleta, its services or contents, as well as any computer equipment of Fiets, other users or third parties.

Unless otherwise indicated, the information contained in Cleta will be considered public. When its use or treatment is subject to some type of restriction, what is expressly indicated in that case must be adhered to.

4. User obligations

The user undertakes to:

  • Not damage, disable or deteriorate the computer systems that support Cleta, other users or third parties, nor the contents incorporated and/or stored therein.
  • Not modify the aforementioned systems in any way and, consequently, not use modified versions of systems in order to obtain unauthorized access to any content and/or services of the site.
  • Not interfere with or interrupt the access and use of Cleta, servers or networks connected to it or fail to comply with the requirements, procedures and regulations of the network connection policy.
  • Make diligent and proper use of the bicycles, locks and other accessories provided by Fiets, refraining from any action or omission that may cause damage, deterioration or loss.
  • Assume full responsibility for any damage, theft, robbery, improper use or total or partial loss of the bicycles, locks and/or accessories provided by Fiets, during the period of use assigned to the user.
  • In case of damage, loss or theft of the physical goods provided, Fiets reserves the right to initiate corresponding legal actions through civil law, in order to obtain full compensation for the damage, including - but not limited to - the reimbursement of replacement costs, repair, lost profits, and any other damage derived from such events.

Fiets may act, by the means it deems pertinent and opportune, against any use of Cleta by users or third parties that opposes these Terms, infringes or violates intellectual property rights, as well as any other right of Fiets, other users or third parties.

Fiets reserves the right to modify, at any time and without prior notice, the presentation, configuration, contents and services of Cleta, being able to interrupt, deactivate and/or cancel any of the contents and/or services presented, integrated or incorporated into it, without cause and without liability.

5. Data Retention Policy

5.1. User Account Deletion Request

The user has the right to request the deletion of their account and terminate their relationship with the Service at any time. To do so, they must send a request through the official contact channel specified in this document team@cleta.app.

5.2. Account Deletion Management Process

Once the deletion request is received, the following will proceed:

  1. Immediate Deactivation: The user’s account will be immediately deactivated, preventing access to the mobile application and the use of the bicycle loan service.
  2. Blocking Period: The personal data associated with the account will not be immediately deleted. Instead, they will be “blocked” and retained for a period of 60 months. During this period, the data will not be used for any active Service operation and its access will be restricted, being kept only to address possible legal, administrative or claims that may arise from the user’s previous relationship with the Service.
  3. Definitive Suppression: After the blocking period, and provided that there are no legal obligations that require longer retention, the definitive suppression of the user’s identifying personal data from our active databases will proceed.

5.3. Account Reactivation

If a user who has requested deletion wishes to use the Service again, they must go through a new registration process. The recovery of their previous travel history is not guaranteed. If the reactivation request occurs during the blocking period, Fiets will evaluate the possibility of reactivating the original account.

5.4. Retention of Anonymized Data

Even after the definitive suppression of personal data, Fiets reserves the right to retain anonymized travel data permanently for statistical, research and Service improvement purposes. This anonymized data cannot be linked in any way to the user.

6. Responsible use and traffic regulations

The user undertakes to use the bicycles safely, diligently and in accordance with the traffic regulations in force in the Oriental Republic of Uruguay. This includes, but is not limited to:

  • Respect traffic signs, traffic lights and circulation rules on public roads.
  • Circulate through authorized places for bicycles, or failing that, where regulations allow.
  • Do not transport more than one person per bicycle, unless expressly permitted by the model and applicable regulations.
  • Do not use the bicycle under the influence of alcohol, narcotics or other substances that alter driving ability.
  • Use the required safety elements when regulations so require.

Fiets will not be responsible for accidents, personal or material damage, injuries, losses, infringements or sanctions suffered or caused by the user during the use of the service. The user assumes all civil, criminal or administrative responsibility derived from the use of the bicycles, and undertakes to hold Fiets harmless from any third-party claims.

7. Intellectual property

All trademarks, trade names or distinctive signs of any kind that may eventually appear on this website are jointly owned by Fiets and UTEC, without it being understood that the use or access to the site attributes to the user any right over the aforementioned trademarks, trade names or distinctive signs of any kind.

8. Responsibility of the owner of Cleta

The veracity, integrity and timeliness of the contents published on the Portal are the sole responsibility of whoever provides them.

Fiets is exempt from any responsibility for damages of any and all nature that may be due to the lack of availability or continuity of the operation of Cleta, services or contents, in particular, although not exclusively, to its reliability, to failures in accessing the different web pages or those from which the services or contents are provided.

Scheduled interruptions will be announced.

Cleta may contain technical linking devices (such as links, banners, buttons) that allow access to websites belonging to third parties, with the sole objective of facilitating users’ search and access to other sites and/or content available on the Internet.

Links to other websites, services or content do not imply approval, in any way, so Cleta, in its merit, disclaims all contractual, legal or any other responsibility that may arise, for example, from the accuracy and use of the linked services and/or content.

10. Duration and termination

UTEC reserves the right to suspend or terminate the Service, temporarily or definitively, totally or partially, at any time, without cause and without generating any right to claim or compensation for the user.

11. Personal data protection

The processing of users’ personal data is governed by our Privacy Policy, which forms an integral part of these Terms and Conditions and can be consulted in the Privacy Policy.

12. Withdrawal and suspension of services

Cleta may withdraw or suspend, at any time and without prior notice, the provision of Cleta services to those users who fail to comply with the provisions in the following cases:

  • Use of the bicycle outside the defined geographical coverage.
  • Repeated late returns.
  • Use of the account for fraudulent purposes or by third parties.
  • Intentional damage to bicycles, locks or stations.
  • Non-compliance with traffic regulations that endanger the user or third parties.
  • Any other serious breach of these Terms and Conditions.

13. Applicable law and competent jurisdiction

Any controversy derived from the application and interpretation of these Terms of Use will be the competence of the ordinary judges and courts of the city of Montevideo, Oriental Republic of Uruguay.

The applicable law will be that of the Oriental Republic of Uruguay.

14. Modification of the Terms and Conditions

Fiets reserves the right to unilaterally modify these Terms and Conditions at any time. Any modification will be notified to users through Cleta. Continued use of the service after notification will imply full acceptance of the new terms by the user.

15. Procedure for reporting content

In case of erroneous, incomplete, outdated content, content that violates intellectual property rights or any other irregular de facto or de jure situation, the user may communicate through the email: team@cleta.app
